Privacy Policy
This is the data processing notice (privacy notice) of Etienne Laine, self-employed photographer, in compliance with the Data Protection (Bailiwick of Guernsey) Law, 2017.
The aim of this policy is to outline what information is collected and why, as well as how your data is managed and protected in line with the data protection law.
Etienne Laine is a self-employed photographer, based in Guernsey, specialising in lifestyle portraiture, wedding photography and corporate imagery.
In order to deliver an effective service to clients, the following information may be gathered and held including:
Client Name
Contact Information e.g. telephone, email, address
Contract or job information
Photograph usage agreements
Correspondence
Photographs
Invoicing Information
The information gathered enables Etienne Laine to carry out core business services, keep financial records and maintain contact with clients in compliance with contractual agreements as well as legal obligations. This includes producing contracts, taking and storing photographs, publishing or printing photographs, contacting clients through email or telephone, billing and invoicing and maintaining financial records. Any information gathered is on a legal contractual basis for legitimate business interests. We do not process special category data as defined by the Law.
Etienne Laine may draw up a formal written contract with clients or by agreeing to Etienne Laine’s services either by writing e.g. in an email or online contact form or verbally, forming a verbal contract. In either of these circumstances, the client agrees to the terms and conditions of service. These terms and conditions are available on the business website as well as in the email signature. In instances, where there is no contract or legitimate business interest, we rely on consent to lawfully process your data. This can be obtained orally or in writing. You have the right to withdraw consent, however, by withdrawing your consent we may not be able to provide you with our core business services.
Any information gathered is provided by the client(s), not from other sources. Personal information, except for images, are not shared with any other third party or transferred outside the Bailiwick of Guernsey without the consent of the client. Clients may opt out of receiving direct marketing by emailing etienne@etiennelaine.com.
Photographs and videos taken by Etienne Laine are the property of Etienne Laine. As part of the terms and conditions of service, these images may be used by Etienne Laine on through print, on his website and on media. Please see terms and conditions for more information.
Data is retained for a reasonable period to comply with statutory obligations or in order for Etienne Laine to deliver you the services that form part of the contract or with your consent. All data is reviewed and weeded accordingly after a period of 7 years. Images or videos may be stored permanently, unless a specified period is stated in the contract. This is to enable clients to access images in the future if the client is no longer able to access the image e.g. if lost or damaged.
The Law provides you with a number of rights, but specifically and of relevance, you have the right to:
Request confirmation of the personal data that we hold about you and what we are doing with your data
Request correction of your personal data if incorrect, out of date or incomplete
Request that we stop ant consent-based processing of your personal data after you have withdrawn that consent
